1. GENERAL

Prior to engaging a contract workforce or contract worker using state-appropriated funds, a department shall:

1.1 Determine and document why and how the use of contract workers fits into the departmental staffing strategies, including consideration of component mission, goals and objectives, existing and future skills needed, compensation costs, productivity, nature of services to be provided and workload.

1.2 Consult with the Human Resources Department to examine and document the legal and personnel issues relating to the use of a contract workforce as described in System Regulation 25.99.03, Section 1.5 and the legal distinctions between an employee and a contract worker.

1.3 Submit a cost/benefit analysis of the current A&M-Commerce workforce to the Assistant Vice President for Business and Administration & Director of Budgeting and Financial Analysis for approval prior to any authorization to hire additional contract workers and/or prior to amending or renewing existing contracts.

1.4 Upon approval, the Director of Contract Administration will report annually on the use of contract workforce for the preceding year following the prescribed format.

2. PROCUREMENT OF SERVICES

2.1 The procurement of contract workforce services with an anticipated value in excess of $2,000 shall be in accordance with the President’s Delegation of Authority. When state-appropriated funds, in access of $10,000 are utilized, the department must enter the appropriate text codes on the requisition in order to document the requirements of sections 1.1 through 1.3 above. The text codes are listed below.

2.2 For all purchases that qualify as contract workforce services, including Intra-System purchases, a department shall retain all supporting documentation in accordance with the University records retention schedule.

2.3 Text Codes
2.3.1 The contract worker(s) are temporarily filling a state employee position.
2.3.2 The contract worker(s) are performing seasonal work.
2.3.3 Our department is unable to attract state employees for the needed position(s).
2.3.4 The contract worker(s) are used to perform highly specialized duties.
2.3.5 All contract worker(s) costs were compared with employee(s) costs and were found to be the most cost effective in performing the duties.
2.3.6 Productivity was compared between contract worker(s) and employee(s) and was found to be the most cost effective decision.
2.3.7 Training cost and training investments were compared between contract worker(s) and employee(s) and the use of contract workers was found to be the most cost effective decision.
2.3.8 The contract worker(s) duties have been reviewed and have been determined that they met factors necessary to meet independent contractor status.
2.3.9 Contract worker(s) shall be afforded the following: protection against discriminatory treatment and be provided a safe work environment.
