USCIS rules state that the employment during OPT must be directly related to the academic major listed on the OPT I-20. It is the responsibility of USCIS to determine if your employment meets the above criteria. We strongly recommend that students keep documentation of their employment that includes a letter from their employer on company letterhead with dates of employment and the nature of employment. Effective April 8, 2008, students may not accrue an aggregate of more than 90 days of unemployment during the 12-month OPT work authorization period on the EAD, and an aggregate of more than 120 of unemployment during the combined 12-month and 17-month OPT Extension work authorization period on the EAD.
